To all judges,barristers,solicitors and legal experst.?
The subject is public law.the question is:”consider the effect on the traditional doctrine of parliamentary supremacy,of the UK’s membership of the european union”. Is parliament still supreme?
The UK is a member of the EU by treaty. As long as Parliament can pass an act withdrawing from the treaty, and no one can stop it, it is Supreme.
About 145 years ago the legislatures of some 13 member states of the United States of America passed ordinances of secession from that union. President Lincoln & the rump US Congress disputed their power to do so & won the argument by force of arms. It is unlikely anyone would seek to force the issue in the EU.
